SAMUEL ADAMS LONGSHOT AMERICAN HOMEBREW CONTEST

OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND D.C. (EXCLUDING RESIDENTS OF CALIFORNIA), 21 YEARS AND OLDER.
1. HOW TO ENTER:

Contest begins at 12:00:00 am Eastern Time (“ET”) on June 22, 2018 and ends at 11:59:59 pm ET on or around July 22, 2018 (the “Contest Entry Period”). From June 22, 2017 to July 22, 2018 visit samueladams.com/longshot; click on the icon for the “LongShot American Homebrew” Contest (the “Contest”) and follow the on-screen entry instructions to upload a thirty second video and a short statement on why you should get the chance to brew with us. Entry must include a video about the entrant’s passion for homebrewing, and showing off their homebrew set up that is thirty seconds or less. If video entry is submitted, maximum length of video is 30 seconds, and maximum file size of video is 5 GB, recommended video file size is 50MB or less. The following video file formats will be accepted: asf, asx, avi, divx, dv, dvx, m4v, mov, mp4, mpeg, mpg, qt, wmv, 3g2, 3gp, 3ivx, 3vx. Limit one (1) entry per e-mail address and per person for the duration of the Contest, regardless of method of entry. Entries received from the same e-mail address or person after the first entry received from that e-mail address or person will be void. All entries become the property of Sponsor and will not be returned. Entries generated by script, macro or other automated or mechanical means will be void. Grand Prize Winner will be announced on or around September 6, 2018.

Entry Requirements: All entries must meet the following guidelines:

  • Only entrant may appear in the video and entrant must be 21 years of age or older. No other individuals may appear in the video or photograph. Sponsor’s products may be depicted in the entry, but entry should not show Entrant consuming such products.
  • Entrant may not violate the rights of any third party or any applicable law or regulation.
  • An entry can only be submitted by a single individual, and the prize will only be awarded in the entrant’s name.
  • Entrant must submit all required releases upon Sponsor’s request.
  • Entries must not have won a previous prize or award nor have been knowingly previously published.
  • Background music can only be used in the video if it is an original composition and recording created by the entrant.
  • Incomplete, garbled or corrupted entries will be disqualified. The Boston Beer Company (“Sponsor”) is not responsible for lost, late, damaged, delayed, incomplete or misdirected entries.
  • By participating, entrant agrees to have his/her video with essay featured on www.facebook.com/SamuelAdams in a gallery related to the Contest and/or on samueladams.com and/or on Twitter, at Sponsor’s option, however being featured in any gallery or on Facebook, samueladams.com, or Twitter has no bearing on judging. This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook or Twitter. You are providing your information to Sponsor and not to Facebook or Twitter. The information you provide will only be used for Contest administration.
  • Content: Each entry must be suitable for display and publication, in all forms of media, including but not limited to the internet, the World Wide Web, print, radio, and network, cable or satellite television broadcast. Entries must be dignified, modest and in good taste, must not be obscene or indecent, including but not limited to containing pornography or profanity, nor contain any offensive or defamatory statements including but not limited to words or symbols that might be considered offensive to individuals of any race, ethnicity, religion, sexual orientation or socioeconomic group, nor include threats to any person, place, business, or group, nor invade privacy or other rights of any person, firm or entity, including, without limitation, any third party trademarks or copyrights, nor portray Sponsor or Sponsor’s brands or products in any way that might tend to subject any of them to public contempt, scandal, disrepute or ridicule. Sponsor reserves the right to make determinations of suitability in its sole and absolute discretion, and to disqualify any entries it determines to be inappropriate for any of the reasons listed above, or for any other reason.
  • All entries remain subject to and must comply with Sponsor’s Privacy Policy made available at http://www.samueladams.com/privacy-policy.aspx (as may be modified from time to time).
2. ELIGIBILITY:

Open to legal residents of the 50 United States and D.C., who are 21 years of age or older at time of entry, except employees, officers, directors and agents of The Boston Beer Company (“Sponsor”), and their respective parents, affiliates, subsidiaries, sales representatives, wholesalers, distributors, printers, and advertising and promotion agencies (collectively, “Promotion Parties”), and members of the immediate families (parent, child, sibling and spouse and their respective spouses, regardless of where they reside) and households of each, whether or not related, who are not eligible to enter or win a prize in the Contest. Void where prohibited. Contest is subject to all applicable federal, state and local laws.


3. JUDGING/VOTING:

There will be three (3) Judging Phases: Phase 1 (June 22, 2018-July 22, 2018): All eligible entries will be judged by qualified Judges based on the following criteria: Originality (20%), Creativity (25%), Explanation or use of Sponsor related products and/or knowledge about homebrewing (25%), Appropriateness to Contest Theme defined as “Tell us and/or show us why you should win a weeklong immersion course in professional brewing at Siebel Institute (20%), and peer review (10%). Phase 2 (July 23, 2018-August 31, 2018): The top (5) highest scoring entries (“Semi-Finalists”) will have an opportunity to submit a homebrew and will be judged by a panel of Samuel Adams employees. Homebrews must be submitted by August 17, 2018. Each homebrew will be judged on its taste, aroma, appearance, and palatability by the judging panel. Phase 3 (September 3-6, 2018): The top three (3) Semi-Finalists will take part in a Skype or other videoconference interview (the “Finalists”). The Semi-Finalist judged to be the best representative of the spirit of the homebrewing and Samuel Adams’ brewing mission by a panel of Samuel Adams employees will be deemed the Grand Prize Winner. Entrants submitting a homebrew will be given rules and entry requirements once selected. In the event of a tie during judging, tied entries will be re-evaluated based on creativity. All prizes awards are subject to verification. Judging is within the sole discretion of the judges noted above based on the stated criteria. All dates listed for judging phases are approximate.


4. WINNER NOTIFICATION:

Potential winners will be notified by mail and/or phone and potential be required to sign and return an Affidavit of Eligibility, Release of Liability and a Publicity Release (unless prohibited) within seven (7) days of date of notification or prize will be forfeited and, at Sponsor’s discretion, a runner-up notified for the applicable geographic division. Failure to return such documents within the specified time period, the return of any prize or prize notification as undeliverable, Sponsor’s inability to contact a potential winner in a reasonable time period or noncompliance with these Official Rules may result in disqualification. Guests of Grand Prize winners will also be required to complete and return Liability and Publicity Releases in a timely fashion.


5. PRIZES AND APPROXIMATE RETAIL VALUES (“ARVS”):

One (1) Grand Prize: The Grand Prize Winner will win a trip for winner and one (1) guest to Boston, MA during a sponsor-specified period in 2018. Trip consists of roundtrip, coach class air transportation from a major U.S. gateway airport nearest winner’s residence to Boston, MA, 5 days and 4 nights standard hotel accommodations (one room, double occupancy), a week long immersion experience at the Boston Brewery; and roundtrip ground transfers between airport/hotel and hotel/brewery and $500.00 in spending money. If winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. ARV: $2,500 each. Each Grand Prize winner will also win a trip with one (1) guest to the 2018 Great American Beer Festival. Trip consists of roundtrip, coach class air transportation from a major U.S. gateway airport nearest winner’s residence to Denver, CO, 4 days and 3 nights standard hotel accommodations (one room, double occupancy), and Friday and Saturday tickets to the Great American Beer Festival. If winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. ARV: $2,500 each Trip. Grand Prize winner will also receive a scholarship to the Siebel Institute’s online brewing education program. ARV: $3,325 each scholarship. Actual value of may vary based on point of departure. Any difference between stated value and actual value will not be awarded. Grand Prize trips must be taken on dates specified by Sponsor or prize will be forfeited and Sponsor will have no further obligation to such winner. Sponsor reserves right to change dates. Winner and guest must travel together on the same itinerary. Guests must be 21 years of age or older and must sign a liability/publicity release prior to issuance of travel documents. Travel must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Travel is subject to availability. Three (3) First Prizes: The top three entrants with the highest votes in Phase 2 will receive a scholarship to the Siebel Institute’s online brewing education program. ARV: $3,325 each scholarship. Each First Prize winner will also win a trip with one (1) guest to the 2018 Great American Beer Festival. Trip consists of roundtrip, coach class air transportation from a major U.S. gateway airport nearest winner’s residence to Denver, CO, 4 days and 3 nights standard hotel accommodations (one room, double occupancy), and Friday and Saturday Tickets to the Great American Beer Festival. If winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. ARV: $2,500 each Trip. No substitutions, cash equivalents, or transfers of prizes permitted by winners. Sponsor reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. First and Early Bird Prizes are awarded “as is” with no guarantee, either express or implied by Sponsor. All prize details are at Sponsor’s sole discretion. Sponsor’s database clock will be the official timekeeper for this Contest and Sponsor’s decision as to the time individuals participate will be final. In no event will more prizes be awarded than the number of prizes stated herein. Limit one (1) Grand and First Prize per email address and per person. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided, including but not limited to for the Grand Prize winners, additional transportation, meals, souvenirs, gratuities, baggage fees, etc. are the sole responsibility of the winners.


6. GENERAL RULES:

By entering Contest, entrants accept and agree to these Official Rules and the decisions of the Sponsor and Judges, which shall be final and binding in all matters. By entering, entrants agree to release and hold Promotion Parties harmless against any and all claims and liability arising, in whole or in part, directly or indirectly, out of participation in the Contest or use or acceptance of a prize including any travel/activity related thereto. Acceptance of a prize constitutes permission to the Sponsor and its designees to use winners’ names, likenesses (and biographical information) for advertising, marketing, promotional and other purposes in any and all media now or hereafter devised, worldwide in perpetuity, without further compensation, notification or permission, unless prohibited by law. Promotion Parties are not responsible for lost, late, garbled, incomplete, undeliverable, damaged, stolen, misdirected, or delayed entries, videos, photos or essays; or for technical, hardware or software malfunctions, lost or unavailable network, cable, satellite, Internet Service Provider (ISP) connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest, or for any errors, problems or malfunctions of any kind whether caused by computer, network, technical, mechanical, printing, typographical or human error or otherwise relating to or in connection with this Contest, including, without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Contest, the processing of entries, videos, photos or essays, the announcement of the prizes or in any Contest-related materials. Promotion Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Promotion Parties are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participation in this Contest or downloading materials from or use of the website. If, in the Judges' opinion, there is any suspected evidence of tampering with any portion of the Contest, or if virus, bugs, unauthorized human intervention or technical difficulties compromise the integrity, security or proper play of the Contest, the Judges reserve the right to modify or terminate the Contest, at the Judges’ sole discretion. If terminated, Judges may, at their discretion, award the prizes from among all non-suspect, eligible entries received up to time of such action using the judging phases specified above. Sponsor reserves the right to disqualify any individual who tampers with the entry process, or who disrupts the administration of this Contest, who intends to annoy, abuse, threaten or harass any other entrant or Sponsor representative or who is otherwise in violation of these Official Rules and void all associated entries. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE WEBSITE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry and he/she must comply with these Official Rules. "Authorized account holder" means the natural person who was assigned an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. FORCE MAJEURE: Sponsor reserves the right to modify, extend, suspend, or terminate the Contest, in whole or in part, if it determines, in its sole discretion, that the Contest or any particular contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Contest or particular contest drawing as contemplated herein. In the event Sponsor is prevented from awarding prizes or continuing with the Contest or a particular contest drawing as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failures, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court of jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Contest in its entirety or the affected portion of the Contest.


7. ARBITRATION:

Except where prohibited by law, as a condition of participating in this Contest, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office in Boston, MA; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and entrant further waives all rights to have damages multiplied or increased.


8. CHOICE OF LAW:

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Commonwealth of Massachusetts, USA.
